Subject: Summary of ASIC v Kobelt - case on statutory unconscionability
List members may be interested in my summary of a recent case by the High Court of Australia, ASIC v Kobelt, which deals with statutory unconscionability and credit arrangements in a remote indigenous community. The court splits 4:3, with strong dissents by Nettle and Gordon JJ and Edelman J. The minority also notes recent Singaporean jurisprudence on unconscionability.
